1. Agreement to Terms
Welcome to Snugg. By accessing or using snugg.social (the "Service"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you may not use the Service.
2. Eligibility
You must be at least 16 years old to use Snugg. By creating an account, you represent that:
- You are at least 16 years of age
- You have the legal capacity to enter into these Terms
- All information you provide is accurate and complete
We reserve the right to verify your age at any time. Accounts created by users under 16 will be terminated immediately.
3. Account Creation and Security
Account Registration
- You create an account by providing your email address and completing the verification process
- You are responsible for maintaining the security of your account and any sessions you authorize
- You must notify us immediately of any unauthorized access to your account
Authentication
- Snugg uses magic link authentication sent to your email
- You are responsible for maintaining access to your email account
- Each magic link is single-use and expires after 15 minutes
Encryption Keys
- Your account includes cryptographic keys that enable end-to-end encryption
- You are responsible for maintaining access to your keys
- If you lose access to your keys, we cannot recover your encrypted content
4. Subscription and Payment
Free Trial
- •New users receive a 14-day free trial
- •No payment information is required to start your trial
- •Your trial automatically converts to a paid subscription unless you cancel
Subscription Plans
- •Subscription fees are charged monthly or annually, as selected
- •All fees are in the currency specified at purchase (USD, EUR, GBP, or CAD)
- •Founding members (first 1,000 subscribers) receive locked-in lifetime pricing
Payment Processing
- •Payments are processed by Stripe, our third-party payment processor
- •By providing payment information, you authorize us to charge your chosen payment method
- •You agree to pay all applicable fees and taxes
Refunds
- •Subscriptions are non-refundable except as required by law
- •You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period
- •No refunds are provided for partial subscription periods
Price Changes
We may change subscription prices with 30 days' notice. Price changes do not affect founding members' locked-in pricing. Continued use of the Service after a price change constitutes acceptance.
5. Acceptable Use Policy
Permitted Use
- Create private groups with friends, family, and colleagues
- Share text, photos, and videos with your groups
- Communicate privately with other users
- Manage your content and account settings
Prohibited Conduct
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Harass, threaten, or abuse other users
- Share illegal content, including child sexual abuse material (CSAM)
- Distribute malware, viruses, or harmful code
- Spam other users or groups
- Attempt to access other users' accounts or encrypted content
- Reverse engineer or attempt to extract our source code (except as permitted by our open-source license)
- Use automated systems (bots) to access the Service without authorization
- Impersonate others or misrepresent your affiliation
Enforcement
Violations may result in content removal, account warnings, temporary suspension, permanent termination, or reporting to law enforcement (for illegal content). We reserve the right to investigate violations and take appropriate action at our sole discretion.
6. Content and Intellectual Property
Your Content
- You retain all rights to content you post on Snugg
- By posting content, you grant us a limited license to store and transmit your encrypted content
- We cannot access your encrypted content and therefore cannot use it for any purpose
- You represent that you have all necessary rights to the content you post
Our Intellectual Property
- Snugg and its original content, features, and functionality are owned by us
- Our trademarks and logos may not be used without permission
- Our Service is open source, which governs code usage
Content Removal
- You may delete your content at any time
- Group administrators may remove content in their groups
- We may remove content that violates these Terms, based on reports and metadata
7. Privacy and Data Protection
Snugg is built with end-to-end encryption. We cannot access your encrypted content (posts, messages, media). Please review our Privacy Policy for detailed information about our data practices.
Under GDPR and applicable data protection laws, you have rights including:
- Access to your personal data
- Correction of inaccurate data
- Deletion of your data
- Data portability
- Restriction of processing
- Objection to processing
8. Account Termination
Termination by You
You may delete your account at any time through Settings. You may choose:
- •7-day grace period: Account marked for deletion; can be restored within 7 days
- •Immediate deletion: Irreversible; all encryption keys destroyed immediately
Termination by Us
We may suspend or terminate your account if you:
- •Violate these Terms
- •Engage in fraudulent activity
- •Fail to pay subscription fees
- •Create risk or legal exposure for us or other users
Effect of Termination
- •Your subscription ends immediately
- •Your encryption keys are destroyed
- •Your encrypted content becomes permanently unrecoverable
- •No refunds are provided for unused subscription time
- •You may export your data before deletion (if using grace period)
9. True Deletion Guarantee
Cryptographic Deletion
- Your private encryption keys are destroyed
- All encrypted content becomes permanently unreadable
- We retain no decryption capability
- Data is not preserved in backups or archives
What Remains After Deletion
- •Minimal metadata for legal compliance (e.g., email address for 30 days)
- •Anonymized analytics data
- •Records required for financial auditing
10. Disclaimers and Limitations of Liability
Service Provided "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Guarantee of Availability
- •The Service will be uninterrupted or error-free
- •Defects will be corrected
- •The Service is free from viruses or harmful components
- •Your content will not be lost
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Liability Cap
Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim.
Encryption Limitations
- •We cannot recover lost encryption keys
- •We cannot decrypt your content if you lose access to your keys
- •You are solely responsible for maintaining access to your keys
11. Dispute Resolution
Governing Law
These Terms are governed by applicable laws, without regard to conflict of law principles.
Informal Resolution
Before filing a claim, you agree to contact us at legal@snugg.social to attempt informal resolution.
12. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- •Posting a notice on the Service
- •Sending an email to your registered address
- •Providing 30 days' notice for changes affecting your rights
Continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service and may delete your account.
